BIC Everyday Online Sweepstakes OFFICIAL RULES NO PURCHASE NECESSARY. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. 1. How To Enter: The Sweepstakes begins at 12:00 a.m. Eastern Time ("EDT") on July 1, 2006, and ends at 11:59 p.m. EDT on December 31, 2006 (the "Sweepstakes Period"). Access www.BicEveryDay.com, click on the Promotions link or icon, and follow the on-screen instructions to complete and submit an entry during the Sweepstakes Period. All entries become the property of the Sponsor and will not be returned. Limit one entry per person per day. 2. Conditions of Entry/Eligibility: Entries must be in English. The entrant is the individual whose name and address appears on the entry form. Only one (1) entrant's name may appear on an entry form. By entering, entrants acknowledge compliance with these Official Rules, including all eligibility requirements. Entrants hereby release Sponsor, its parent, affiliate, or subsidiary companies, advertising and promotion agencies, and their respective employees, directors, officers, shareholders, agents, successors and assigns, from any and all liability with respect to all aspects of the Sweepstakes and the possession, acceptance, use or misuse of prizes. By accepting prizes, winners grant Sponsor the right to use winners' names, likenesses and biographical information for commercial purposes worldwide in all media now known or hereafter discovered, without limitation or additional compensation, unless prohibited by law, and agree to confirm their consent to such use in writing upon request. The winners will be required to sign an Affidavit of Eligibility/Liability Publicity Release (which shall be e-mailed and also sent via U.S. mail to the winners). Sponsor assumes no responsibility for lost, late, misdirected, damaged, garbled, illegible or incomplete entries, or for entries that are not submitted in accordance with these Official Rules. All such entries will be disqualified. Sponsor further assumes no responsibility for computer system, hardware, software, network, program or other damage, virus, bugs, errors or failures of any kind, whether human or technical in nature, that may arise from or in connection with participation in this Sweepstakes, or in the transmission, receipt or processing of entries or for printing errors in these Official Rules or in any advertisements or correspondence in connection with this Sweepstakes. All entrants further acknowledge that if they are chosen as a winner, certain of their personally identifying information may be disclosed to third parties at least as required by law, including, without limitation, on a Winners' List. Sweepstakes participants must have Internet access as of May 15, 2006 and at all times during the promotion. Participants represent and warrant that they have not purchased any kind of Internet service in order to participate and/or enter this Sweepstakes. All entries become the sole property of Sponsor and will not be returned. In the event of a dispute concerning who submitted an e-mail entry, the entry will be declared to have been made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. 3. Prizes: First Prize for each monthly period of the Sweepstakes Period (see Monthly Deadline Schedule in Section 4 below) will be one (1) Panasonic DVD VDR-D200 Camcorder, with an Approximate Retail Value ("ARV") of $600.00. The following Grand Prize will be awarded at the end of the Sweepstakes Period: One (1) BIC Sport Bilbao™ Kayak. ARV: $430.00. Limit one prize per person for the entire Sweepstakes Period. All prizes will be awarded if properly claimed. Odds of being selected depend on the total number of eligible entries received. 4. Monthly Deadline Schedule: On the dates noted below, one winner will be chosen at random by an independent agency for the monthly periods noted below.
Potential winners will be notified by e-mail that they have won and they will provide their mailing address to the Sponsor at that time. If a mailing address has not been provided within one week of notification, or if the potential winner fails to respond to notification attempts after seven days, or if an e-mail or a prize is returned as undeliverable, the winner may be disqualified, and an alternate winner may be selected at the Sponsor's sole discretion. In the event the winner declines the prize or the winner fails to return the completed Affidavit of Eligibility and Liability/Publicity Release within two weeks from the date of mailing, the Sponsor may elect, at its own discretion, to select an alternate winner. The prize will be mailed out to the winner after Sponsor receives mailing address and signed Affidavit of Eligibility and Liability/Publicity Release. The first and last name, town/city, and state of residence for each winner will be posted on the Sponsor's web site. 6. Sweepstakes is open to legal residents currently residing in the 50 United States and the District of Columbia who are age eighteen (18) or older as of the date of entry, except employees of Sponsor, its affiliates, subsidiaries, distributors, retailers and advertising and promotion agencies and members of the immediate families or households of any of the above. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void outside the 50 United States and the District of Columbia and where prohibited by law. All federal, state and local taxes, if any, are the sole responsibility of the winner. By entering the Sweepstakes, entrants agree to abide by these Official Rules and decisions of the Sponsor with respect to all aspects of the Sweepstakes, which are final. No correspondence will be entered into except with the selected winners. 7. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should virus, bugs, fraud or other causes beyond the control of the Sponsor corrupt the administration, security or proper play of the Sweepstakes and in such case to award the appropriate number of prizes from among eligible entries received as of date of cancellation/suspension. CAUTION. Governing Law: The Sweepstakes and these Official Rules will be governed by the laws of the State of Connecticut, whose courts shall have exclusive jurisdiction in the event that any dispute arises regarding the Sweepstakes or the prizes. 10.
